This document serves as both the Terms of Service and End User License Agreement (EULA) for Habitage.
By downloading, installing, or using Habitage ("the App"), you agree to be bound by these Terms of Service ("Terms") and Apple's Standard End User License Agreement (EULA). If there is a conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall take precedence. If you do not agree to these Terms, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and the Apple App Store Terms of Service.

The App provides a 7-day free trial period starting from your first use. During this period, all features are available at no cost. No payment information is required to start the trial. After the trial expires, a subscription is required to continue using premium features.
The App offers subscription plans at various price points and billing intervals. Current pricing is displayed within the App and on the App Store product page. Prices may change from time to time.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew at the same price and duration unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings (Settings > Apple ID > Subscriptions).
All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policy.
We may modify, add, or remove features at any time. Purchases grant access to the App's functionality as it exists at any given time, not to specific features.
You own all data you create in the App. Your habits, completions, streaks, and progress are yours.
All data is stored locally on your device. If you enable iCloud sync, your data is stored in your personal iCloud account. We never have access to your data.
We are not responsible for data loss resulting from device failure, iOS updates, or deletion of the App. We recommend enabling iCloud sync as a backup.
The App, including its design, animations, scenes, sounds, badge artwork, and code, is protected by copyright and intellectual property laws. The "Habitage" name, concept, and all associated creative elements are proprietary.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Habitage is a habit tracking tool. It does not provide medical, psychological, or professional advice. Consult appropriate professionals for health-related decisions.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill resulting from your use of the App.
We reserve the right to terminate or suspend your license to use the App at any time. Upon termination, your data remains on your device — we cannot and do not delete your local data.
These Terms shall be governed by the laws of the United States and the State of Alabama, without regard to conflict of law principles.
We may modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the App after changes constitutes acceptance.
