Terms of Service & End User License Agreement (EULA)
This document serves as both the Terms of Service and End User License Agreement (EULA) for AquaTale.
1. Agreement to Terms
By downloading, installing, or using AquaTale ("the App"), you agree to be bound by these Terms of Service ("Terms") and Apple's Standard End User License Agreement (EULA). If there is a conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall take precedence. If you do not agree to these Terms, do not use the App.
2. License Grant
2.1 Limited License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and the Apple App Store Terms of Service.
2.2 License Restrictions
You agree not to:
- Modify, reverse engineer, or decompile the App
- Copy or redistribute the App without permission
- Use the App for any illegal or unauthorized purpose
- Remove or alter any proprietary notices
3. Subscriptions and Purchases
3.1 Free Trial
The App provides a 7-day free trial period starting from your first use. During this period, all features are available at no cost. No payment information is required to start the trial. After the trial expires, a subscription is required to continue using premium features.
3.2 Subscription Plans
The App offers subscription plans at various price points and billing intervals. Current pricing is displayed within the App and on the App Store product page. Prices may change from time to time.
3.3 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew at the same price and duration unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings (Settings > Apple ID > Subscriptions).
3.4 Refunds
All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policy.
3.5 Feature Changes
We may modify, add, or remove features at any time. Purchases grant access to the App's functionality as it exists at any given time, not to specific features.
4. Your Data
4.1 Ownership
You own all data you create in the App. Your water intake records, hydration history, and progress are yours.
4.2 Local Storage
All data is stored locally on your device. If you enable iCloud sync, your data is stored in your personal iCloud account. We never have access to your data.
4.3 Data Loss
We are not responsible for data loss resulting from device failure, iOS updates, or deletion of the App. We recommend enabling iCloud sync as a backup.
5. Intellectual Property
The App, including its design, animations, scenes, and code, is protected by copyright and intellectual property laws. The "AquaTale" name, concept, and all associated creative elements are proprietary.
6. Disclaimers
6.1 "As Is" Basis
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6.2 Not Medical or Nutritional Advice
AquaTale is a water intake tracking tool. It does not provide medical or nutritional advice. Consult appropriate professionals for health-related decisions.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill resulting from your use of the App.
8. Termination
We reserve the right to terminate or suspend your license to use the App at any time. Upon termination, your data remains on your device — we cannot and do not delete your local data.
9. Governing Law
These Terms shall be governed by the laws of the United States and the State of Alabama, without regard to conflict of law principles.
10. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the App after changes constitutes acceptance.
